Package tours and contract law - a comparative study

Project objective

1. The research schall describe the implementation of Directive 90/314/CE on package tours in Italy (Legislative Decree n. 111 of 17 March 1995) and its bearing on consumer protection. 2. The methodological approach of the research takes into account: - EU legislation and International Agreements; - Italian legislation (Legislative Decree 111/95); - National legislation of some Members States of the EU. 3. The specific contents of the research are: - Background of Directive 90/314/CE: Can tourists be regarded as consumers. - Italian civil code and legislation on package tours; Brussels Convention (ratified by Act n. 1084 of 27 December 1977), Legislative Decree n. l l l/95; rules on abusive clauses. - Liability of tour operators and travel agents. - Remedies for breach. - Formation of contract: formalism and duty of information. - Renegotiation and early termination. The proposal will be implemented together with the University of Freiburg research team dealing with the legal comparative aspect of tour package contract. As well as providing a deeper knowledge of European Member States (EUMS) legal system, the training in Freiburg will be the occasion to compare different research approaches. A deep knowledge of the issues on tour package is important for the service industry. This is particularly important with regard to the italian socioeconomic reality, where the small and medium enterprise (SME) has a central roll. Furthermore tourism is one of the biggest entry in italian gross internal product (GIP) and, at the same time, it will be a realistic development, especially for our less favourite regions.
