Integration through Expertise: Two models of the interaction between Law and Science in Internal Market Regulation

Project objective

Research objectives and content:The role of scientific expertise in health, safety and environmental regulation is likely to increase significantly both at the EU level and at the WTO level. This project compares two systems of incorporating scientific and technical knowledge into Internal Market Regulation based on completely different approaches to the division of public and private responsibilities and legitimation structures. One concerns the private" self-regulatory model under the New Approach to Technical Standardisation and Harmonisation; the other the newly refurbished "public" structure of scientific committees in Consumer Health and Safety.By means of empirical research and a combination of legal, institutional and discourse analysis, the relationship between the formal conditions of expert deliberation and the social reality of interaction between experts, regulators, industry, public interest groups and public opinion will be investigated in a comparative perspective. The research will evaluate two innovative methods of regulation, and aims at generating recommendations as regards the institutional design and regulatory quality of Community legislation.Training content (objective, benefit and expected impact)The training will contribute to a deepening of multi-disciplinarity in EU legal studies by means of the integration of perspectives from political sociology and discourse analysis in the study of Internal Market Regulation.Links with industry / industrial relevance (22)."
